Terms of service

1. Who we are and what these terms cover
These terms are an agreement between you and Sireto BV, a company registered in the Netherlands (KvK 73807508, Zwolle, The Netherlands), "we" below. They cover the hosted Custom Domain API service: the plans on customdomainapi.com, the customer portal at app.customdomainapi.com and the edges we run for you.
They don't cover the open-source software itself. You can run it on your own servers under its own licence, published at https://github.com/sireto/custom-domain.
Our acceptable use policy and our data processing agreement are part of these terms. By creating an account or starting a plan, you accept them on behalf of the business you represent.
2. Business customers only
The service is for businesses that offer their own software to their own customers. You must be acting for a business, not as a consumer, and you confirm you can bind that business to these terms.
3. Your account
- Give accurate details, and keep the email addresses of your account's users current: we send sign-in links and notices there.
- You're responsible for everything done with your account, your sign-in links and your API keys. Keep keys secret, and rotate or revoke one as soon as you suspect it has leaked.
- Each account can have one Free application. Don't open more accounts to get around a plan's limits.
4. What the service does
You register your customers' hostnames through the API. Once a hostname's DNS records show that it may be used and point at your edge, the edge obtains a certificate for it and forwards its traffic to the origin server you registered, telling your origin which of your customers each request is for.
- Free runs your application on an edge we share between Free customers, under edge.customdomainapi.com.
- Paid plans (Starter, Growth and Scale) run a server of your own, an "edge", in the location you choose, under an edge hostname on your own domain.
Each plan's allowances are shown on our pricing and when you order. We may improve or change features over time. We won't remove a feature you pay for during a paid period without telling you at least 30 days before.
5. Your customers' domains and your content
- Register only hostnames that you, or the customer you register them for, are entitled to use. The DNS ownership check is a safeguard, not permission.
- The content and services reachable through your edge come from your origin. You're responsible for them, and for having the rights and consents they need.
- Your origin must be a server you control. The service may not be used to route traffic to third-party sites you don't operate.
6. Prices, billing and taxes
- Prices are in US dollars and exclude VAT and other taxes, which we add where the law requires. Payment is handled by Stripe.
- Paid plans are billed in advance, monthly or yearly. A yearly plan costs ten times the monthly price.
- Domains above your allowance. A domain counts while it is registered and not deleted. On Starter and Growth, each domain above the plan's allowance is billed at the price shown for the plan, monthly in arrears, based on the last count we record in the billing month. Each plan also has a ceiling shown when you order: above it, new registrations are refused until you delete domains or move to a larger plan, and existing domains keep working. On yearly plans, these extra domains are billed on a separate monthly invoice. Scale has no price for extra domains: above its allowance, contact us.
- We warn your account by email when you reach 80% of your plan's allowance.
- If a payment fails, Stripe retries it for a period and lets you update your card. If it still can't be collected, the subscription is cancelled, and the edge ends as described in section 8.
- We may change our prices by telling you at least 30 days before. A change applies from your next billing period after that notice, and you can cancel before then.
- Payments are not refunded for a partial period, except where we charged you in error or the law requires a refund.
7. The Free plan
- Free needs no card. It includes up to 25 domains.
- Traffic to your application's hostnames is limited to 600 requests in any 60 seconds and 100 in any one second. Above either, the edge answers with "too many requests".
- Each API key may make up to 60 API requests a minute.
- Fair use: up to 10 GB of responses served a month. Above that we email you, and if it keeps happening we'll talk to you about a paid plan. Nothing is switched off automatically for traffic alone.
- Free comes with community support on GitHub, and without any commitment to availability.
- We may change the Free plan's limits, or end the Free plan, by telling you at least 30 days before.
8. Cancelling, and what happens at the end
- You can cancel a paid plan at any time in the portal. It ends at the end of the period you have paid for, and until then you can change your mind.
- Export window. When a paid plan ends, its edge keeps running and serving your customers' hostnames for 14 days, so you can download a backup of its database from the portal and move your customers' hostnames elsewhere. After those 14 days, or earlier if you choose "Delete now", we delete the edge's server and everything on it.
- DNS records. When an edge is deleted, its addresses are released. Remove or repoint the DNS records that point at them (your edge hostname's A and AAAA records, and your customers' CNAME records), or someone else may later be able to serve those names. We remind you of this by email.
- You can close a Free application or your account at any time by contacting us.
9. Acceptable use and suspension
You must follow our acceptable use policy. If you or your customers' traffic break it, we may suspend your application or edge: its hostnames stop being served and its API keys stop working. We tell you why, by email and in the portal, and lift the suspension once the problem is resolved. Where possible, we warn you first. We suspend without warning when the law requires it, or to stop serious harm such as malware, phishing or an attack on others.
10. Your data
- Your data stays yours. We use it only to provide the service, and we don't sell it.
- Requests to your customers' hostnames pass through your edge to your origin. For personal data in them, and in what you store with us, we act as your processor under our data processing agreement.
- Backups. On Growth and Scale, we keep daily backups of your edge's database for 30 days. On Starter, no backups are included: download a backup from the portal yourself if you need one.
- We protect the service with measures appropriate to the risk. These include certificates for every hostname, encrypted secrets, isolation between customers, and access limited to the people who operate it.
11. Availability and support
We work to keep the service available and to upgrade it with as little disruption as we can, but we don't guarantee uninterrupted service, and no plan includes a service level agreement unless we agree one in writing. Paid plans include email support at info@sireto.com.
12. Liability
- The service is provided "as is". To the extent the law allows, we give no warranties beyond those in these terms.
- To the extent the law allows, we aren't liable for indirect or consequential loss, such as lost profits, revenue or data. Our total liability in any 12 months is limited to the amount you paid us for the service in those 12 months. For the Free plan, that amount is zero.
- These limits don't apply to liability that can't be limited by law, such as for intent or gross negligence.
13. Ending the agreement
We may end your use of the service, or of a plan, if you seriously or repeatedly breach these terms, if you don't pay, or if the law requires it. We tell you, and where possible give you time to fix the problem first. Sections 8, 10 and 12 continue to apply after the end.
14. Changes to these terms
We may change these terms. For a change that affects you materially, we email your account at least 30 days before it takes effect. If you continue to use the service after that, the new terms apply. If you don't accept them, you can cancel before they take effect.
15. Law and disputes
Dutch law governs these terms. Disputes go to the competent court in the Netherlands for the place where Sireto BV has its registered office.
